🌱 Nature Is Our Right and This Is the Era of Climate Lawsuits
Investigative heavy-hitter Amy Westervelt returns with Damages to unpack the litigation engulfing our natural world. Its first season, entitled The Forest for the Trees, covers the rights-of-nature and the hundreds of legal cases around the world that implore companies and governments to take accountability for their roles in the climate crisis.
It's not easy to summarize the legalities and lawful significance of the environment, but Westervelt and the Damages team put in the effort to help us avoid the legalese that can bog down a meaningful conversation. We get to focus on the importance of peoples' relationships with nature and what puts it all at risk.
Throughout the 5-episode season, we learn about novel legal approaches that bring to light the importance of nature and the rights needed to lessen the impacts of the climate crisis. It plays like a courtroom drama but the plaintiffs are us and we're represented by nature – manoomin or wild rice in Ojibwe, the Te Urewera rainforest on New Zealand’s North Island, and the fourth-largest Great Lake; Lake Erie.
Future seasons will cover fraud cases in the US against Big Oil to constitutional cases in countries like Guyana, Australia, and Ecuador; the latter of which was the first country to include rights-of-nature in its constitution in 2008.
As far as we can tell, bringing awareness to the legal battles ongoing on behalf of people and the planet is a cornerstone in giving us a fighting chance to steady and reverse the effects of the climate crisis. If we can improve our environmental literacy and restore an appreciation of just how interconnected the environment is, we'll be able to think critically and do critically so we can avoid any further damages.
